1. Introduction

Your privacy is very important to the Campbell Soup Company, its subsidiaries, and its affiliates (“CSC,” “our,” “we,” or “us”). We have created this Privacy and Cookies Policy to provide transparency about the type of information we collect from you; how we handle your information; how your information is stored and protected; and how you can make choices to control certain uses of your information.

This Policy summarizes our practices regarding the collection, use, disclosure, and storage of personal information, including but not limited to (i) our websites; (ii) third-party websites where this Policy is posted; (ii) our mobile applications; (iii) email or text distribution lists; and (iv) any other online interactive feature or service that provides an authorized link or URL to this Policy (collectively, the “Site” or “Sites”).

You may access our Sites from a number of different devices, such as a computer, mobile phone, tablet or other device; however, this Policy governs your use of our Sites regardless of the means of access. By using or accessing our Sites, you consent to the terms of this Policy.

We may update this Policy from time to time in our sole discretion. Please review this Policy carefully and check the Policy posted on our Sites periodically so that you are aware of any changes. We will indicate the date we last updated this Policy.

This Policy does not cover the practices of third-third party websites without a link to this Policy in the footer of the website, including those that may disclose information to us and links to third-party websites that you visit by clicking on a link from our Sites.  We recommend that you read the privacy statements of each site you visit to understand the site’s privacy practices. We are not responsible for the privacy practices of sites that do not link to this Policy. Your use of our Sites is subject to our Terms of Use, which you agree to by using or accessing our Sites. If you do not agree to these Terms, please refrain from using our Sites and providing us with any information.

2. Information We Collect

We may collect various types of information from you depending on how you interact with our Sites, as described below.

Information You Provide to Us.  We may receive and store information that you provide to us voluntarily when you visit our Sites. For example, we may receive information from you when you register for an account, purchase an item from us online, or use our online tools (e.g., the Recipe Box on Campbells.com/kitchen); subscribe to an electronic newsletter; send us a question or comment; post a photograph or video; enter or respond to a survey, contest, sweepstakes or other promotional program; or otherwise provide information directly to us.  This information may include your:

  • Name;
  • Email address;
  • Phone number;
  • Mailing address;
  • Age or date of birth;
  • Gender;
  • Username and/or password;
  • Payment information (e.g., credit card) when making a transaction;
  • Demographic information;
  • Preferences (e.g., on foods/recipe interests, website usage, grocery store chains, and input provided by participating in marketing focus groups and surveys); and
  • Order and purchase information.

Social Media.  If you choose to share information about yourself in a public forum, such as through a social media platform like Meta (Facebook) or Twitter, or in any user-generated content area of our Sites, we consider that information to be public and not private. Others with access may read, collect and use that information. You assume the risk that your information may be read, collected and shared by such other parties.

Sweepstakes, Contests, or Promotions.  When you choose to enter certain of our sweepstakes, contests, or other promotions, and in accordance with the terms and conditions of the promotions, your information may be disclosed to third parties who help administer the promotions, including in connection with winner selection prize fulfillment, aggregated data analysis , and marketing purposes. Your information also may be disclosed as required by law, such as on a winners list. Further, by entering a promotion, you are agreeing to the official rules that govern that promotion.  All terms applicable to the promotion will be made available to you at the time you enter the promotion.

Surveys, Focus Groups, Market Research and other User-Generated Information.  We engage consumers directly, as well as through marketing and consumer survey vendors, to help us improve our products and offerings.  Some of our Sites enable users to submit their own content for use in contests, blogs, message boards, and other functions.  With your consent, we may audio and video record focus group interviews and discussions.  

Specific or Precise Geolocation.  Specific GPS location tracking is data shared by your mobile device that shares the location of the device within a radius of 1,750 feet (approximately 1/3 of a mile).  With your consent, our Sites may collect your specific location to provide location-based services, such as assisting you in finding stores that carry our products or identifying special offers that may be of interest to you. In order for our Sites to identify your location, you must enable this functionality through your device settings. You may opt-out of the continued collection and use of this information by adjusting the settings on your device.

Non-specific or rough geolocation.  An IP address can be used to identify the general location of an Internet-connected device, such as the country, state, city, or general area in which it is connecting to the Internet.  This is automatically collected from your device and web browser.  An IP address is an online unique identifier for every internet-connected device.

Mobile Devices and Applications.  Certain mobile devices provide various capabilities that can be used, for example, to identify the physical location of such devices. Mobile devices also transmit Caller ID data when a call is made or text message is sent.  Please review the settings on your mobile device to set your privacy and location tracking preferences.  With your consent where required by law, we may collect, use, transmit, process and maintain unique identifiers, Caller ID data, location-based data, and other similar information when you use your mobile devices to access our Sites, including to provide the services you request, tell you about offers we think you will value and improve your experience on our Sites.  We also may share this information with our business partners and use it for our analytical or business needs.  Please also see Cookies, Web Pixels and Similar Technologies section below.

Independent Distributor Partners.  Some of our brands and affiliates, such as Snyder’s-Lance, Inc., Pepperidge Farm, and others use an independent Direct Store Delivery (DSD) network of independent businesses to get products to market.  If you are an Independent Distributor Partner and register to use our mobile app, information from your device may be shared automatically with us, including an IP address, user agent string, device ID, and log-in information.  Please review your device settings to manage your preferences.  We may use the information you share with us and is automatically collected from a mobile application for analytical and security purposes and to help improve our business operations and supply chain.  

Job Applicants.  If you apply for a job with us, we collect personal information you provide in connection with a job application or related inquiry, such as information contained in a resume, cover letter, or similar employment-related materials. We use this information for the purpose of processing and responding to your application for current and future career opportunities, conducting interviews and facilitating the on-boarding process in the event you accept a position with us. With your consent, we may also obtain personal information from third parties, such as professional references, former employers, and services that perform background checks and drug screenings.  For additional information, please review the privacy notice on our career portal.

Information Collected from Other Sources.  We may also collect additional information about you from other sources, including public databases and data aggregators. This information may include purchase behavior, market research data or publicly observed data via online activities, such as blogs, social media or other user generated content sites. We may combine this information with other information we collect from you to customize and improve the relevancy of our Sites, services and products.

3. Cookies, Web Pixels and Similar Technologies – Information We May Automatically Collect from Your Device

CSC and third parties may collect information about you when you use the Sites, using cookies, web beacons and other similar technologies.  A “cookie” is a small amount of data that is sent to your browser from a web server and stored on your computer or device. Among other things, cookies allow us to facilitate the administration and improve the effectiveness of our Sites as well as further tailor and enhance your experience to your interests. You may set your browser to decline non-essential cookies. If you do so, you may not be able to fully experience certain interactive features of our Sites.

We may automatically collect information about your interactions with our Sites and online ads and may combine this information with other information about you in order to customize your online experience with us. The information we automatically collect may include your IP address, referring URLs, browser and device characteristics, browsing behavior (e.g., date and time of visit, length of visit, clicks on product information or other content) and your response to our email campaigns (e.g., whether and when you open our email, the links you click). We may use cookies, and other similar industry standard technologies to capture this information.

We also use third party analytics companies, such as Google Analytics, to analyze the usage of our Site for internal purposes. These analytics companies may use cookies and other tracking mechanisms to collect data about how you use our Sites and provide us with aggregate information on such usage, which helps us improve the performance of our Sites.  Please review Google’s privacy policy and the Google Analytics Privacy Controls to learn more about Google’s privacy practices and how to disable this function  

We may allow third parties to use cookies and other online tracking tools to better understand your behavior and browsing activities, so that we can serve you targeted advertising (also commonly referred to as “interest-based” or “behavioral” advertising) while on our Sites and display our ads to you when you visit other sites. These third parties may passively collect information with these tools so that content specific to your interests can be delivered to you online.

Session-Replay Technologies. We may use third party services that employ software code to record users’ interactions with the Sites in a manner that allows us to watch DVR-like replays of those user sessions. The replays could include users’ clicks, mouse movements, scrolls, and keystrokes/key touches during those sessions. These replays may be used for analytical purposes, to help us diagnose usability problems and identify areas for improvement. One company that may provide this service for Us is Hotjar. You can learn more about Hotjar at https://www.hotjar.com/legal/policies/privacy/.   Depending on the web browser you use, it might be possible for you to prevent Hotjar from collecting certain data when visiting a Hotjar Enabled Site. 4. How We Use and Share Your Information

We may use your information as follows:

  • to provide you with support and respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses;
  • to send you relevant administration information regarding our Sites;
  • to create, maintain, customize, and secure your account (e.g., Campbell’s Kitchen) with us;
  • to supply you with newsletters, promotional emails about us and our partners, product information, event-related news and surveys and samples;
  • to communicate with you about our sweepstakes, contests, loyalty and rewards programs, coupons, rebates, premiums and other promotions which you have entered or joined or for which you have requested information, including for the purpose of notifying you if you win;
  • to identify your consumer review on our Sites, if you provide your information for disclosure;
  • to process your requests, orders, transactions, purchases, payments, and prevent transactional fraud;
  • to conduct research and perform analysis in order to measure, maintain, protect, develop and improve our products and services;
  • to detect, investigate and prevent activities that may violate the law or our policies;
  • to respond to law enforcement requests and as required by applicable law, court order or governmental regulation;
  • for testing, research, analysis, and product development, including toe develop and improve our Sites, products, and services’
  • to personalize your experiences on our Sites and to deliver content and product and service offerings relevant to your interests, including tailored offers and ads through our Sites, third party sites, and via email or text message (with your consent, where required by law);
  • to help maintain the safety, security, and integrity of our Sites, products and services, databases, technology assets, and business; and
  • to otherwise maintain and optimize our Sites.

We may share your information among our brands, affiliates and subsidiaries.

We also hire third-party vendors to perform services on our behalf and may share your information with them. These third parties are obligated to keep your information confidential and only use it as necessary to perform such services. For example, we may share your information with our agencies to help us administer a sweepstakes or other promotion; deliver content, samples, products, gifts and prizes; or provide you with customer service.

We use Shopify and Gold Belly to power our online stores. You can read more about how Shopify and Gold Belly use your personal information here:  https://www.shopify.com/legal/privacy and https://www.goldbelly.com/privacy-and-security.html.  When you make a purchase on our Sites, your payment information is shared directly with an online payment processor (such as Stripe, Google Pay, or PayPal) to fulfill your order.

We may also share your information when we believe it is necessary to comply with the law or a government request; to prevent damage or injury to us or others; or to protect our rights. For example, we reserve the right to and may disclose your information in response to requests from local, state or federal law enforcement officials; any judicial, administrative or similar proceeding or order, such as a subpoena; to investigate suspected fraud, harassment, physical threats or other violations of our Site policies or the rights of third parties; or to investigate any suspected misconduct.

We may also share your information in connection with a merger, acquisition, sale or reorganization or the potential thereof, including with our successors in business and purchasers of Site assets, or with our parent or affiliate companies for corporate reporting.

Social Media Services

Our Sites may provide you with the ability to register, log on to, “like” or otherwise interact with social media services, such as Meta (Facebook), Instagram, Twitter, Pinterest or YouTube. We do not control these social media services or your profiles on these services, and we do not establish privacy settings or rules for how your information on such services will be used. If you choose to log on to or submit information through any of these social media services, your information will be subject to the applicable social media service’s privacy policy. You are encouraged to read such policy to learn more about how the social media service will handle your information. By accessing any social media service, you will be assuming the risk that the information you provide on that service may be viewed and/or used by us or third parties for any purpose. You agree that we are not responsible for any acts or omissions by these social media service providers.

5. How We Protect Your Information; Data Retention

The security of your information is important to us. We have adopted technical, administrative, and physical security measures to help protect your information from loss, misuse, unauthorized access, alteration, and disclosure. We have also put in place procedures to deal with any suspected security incidents and notify individuals that may be impacted by a security incident, if necessary.

Due to the inherent open nature of the Internet, we cannot ensure or warrant the security of any information you transmit to us or any information provided online. We urge you to take every precaution to protect your personal data while you are on the Internet.  At a minimum, we encourage you to make sure that you are using a secure browser as you surf the Internet.  Please refer to the websites of the U.S. Federal Trade Commission and the Office of the Privacy Commissioner of Canada for information on how to protect yourself from identity theft.

By using our Sites, you accept all risks associated with any data transmission, including the risk that your information may be intercepted in transit and agree that we will not be liable for disclosures of your information due to errors in transmission or unauthorized acts of third parties.

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes for which we collected it, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal and regulatory requirements.  In some circumstances We may anonymize your personal data (so that it can no longer be associated with you) for statistical or analytical purposes, in which case we may use this information indefinitely.

6. Your Privacy Choices

Depending upon where you live, your rights may include:

  • The Right to Know and Access.  The right to request to know and access the categories and specific pieces of personal information (also called “personal data”) we have collected about you.  
  • The Right to Correct.  The right to request that we amend or update your personal information where it is inaccurate or incomplete.    
  • The Right to Delete.  The right to request that we delete any personal information we have collected about you.  We will delete your personal information if we have no other legal ground or purpose to retain it.   
  • The Right to Opt-Out of Sale.  We do not “sell” your information as the word “sell” is commonly understood.  In other words, we do not give your personal information to data brokers or other third parties in exchange for money.  Some state laws, such as the California, Colorado and Connecticut privacy laws broadly define a “sale” to include as any sharing of personal information with third parties in exchange for monetary or other valuable consideration.
  • The Right to Opt-Out of Targeted Advertising. “Targeted advertising” means displaying advertisements to a consumer where the advertisement is selected based on personal data obtained from that consumer’s activities over time and across nonaffiliated websites or online applications to predict such consumer’s preferences or interests. This may also be referred to as cross-context behavioral advertising, interest-based or tailored ads.
  • The Right not to Receive Discriminatory Treatment.  Businesses cannot discriminate or retaliate against you for exercising your privacy rights.  The fact that you have elected to exercise these rights will have no adverse effect on the price and quality of our services or products.
  • Right to Appeal.  If we decline to take action in any privacy request that you submit in connection with the rights described in this Section, you may ask that we reconsider our response by submitting a request online at www.thecampbellscompany.com/ccpa-request  or by calling us at 1-800-257-8443.  You must ask us to reconsider our decision within 45 days after we send you our decision.  

We do not create consumer profiles or automate decisions that produce legal or similarly significant effects concerning a consumer, which means a decision that results in the provision or denial of financial or lending services, housing, insurance, education enrollment or opportunity, criminal justice, employment opportunities, health-care services or access to essential goods or services.

Please note that, except for California and Canadian residents, these rights to do not apply to you in the employment context, such as information about your job application or status as an employee of a company.

Website Cookies, Pixels, and Similar Technologies 

Whether cookies are placed on your computer or mobile device is something you can control.  Virtually all web browsers allow you to run a scan to see the cookies that are in use, along with the ability to clear them individually or clear all of them. How to Access, Correct, and Delete Your Information

If you choose to share personal information with us, you may have the opportunity to update that information by logging into your account and updating your profile information.  You also may update your information by contacting us.  Please note that we may need to retain some information about you in order to satisfy our legal and security obligations. Some of your information may also remain in backup storage even if you ask us to delete it. 

You may be entitled under local laws to request to access, delete or object to the processing of information that we hold relating to you. Regardless of where you live, we will endeavor to respond to your request within a reasonable period of time provided that we are able to verify your identity and locate your information.   We reserve the right to update our processes and policies as to whether we will respond to these requests at any time, in our sole discretion, unless we are otherwise required to do so by applicable law.  To submit a request to access, delete, or opt-out out of certain processing activities associated with your information please visit www.thecampbellscompany.com/ccpa-request  or call us at 1-800-257-8443.

Opting Out of Marketing Communications

You can opt out of receiving commercial email or text messages by following the instructions contained in any such message or by contacting us directly. To exercise your right to opt-out:

  • Promotional Emails:  click the “unsubscribe” link in the footer of the message and follow the on-screen directions;

  • Utilize one of the methods in the Contact Us section below and make your opt-out request. Be sure to specify the electronic newsletter(s) you would like to stop receiving.

Please note that it may take up to ten business days for us to process your request and update your preferences.  Additionally, even if you unsubscribe from marketing or promotional e-mail messages and newsletters, we may still need to contact you for administrative or transactional purposes, such as service announcements, payment, log-in, and registration information.

The Right to Opt-Out of Sale and Sharing of Your Personal Information for Cross-Context Behavioral Advertising

Some states, such as California, provide individuals with the right to opt-out of the sale or sharing of personal information for cross-context behavioral advertising (commonly referred to as interest-based or tailored ads).  This right provides individuals with the opportunity to opt-out of having their information sold, shared, or used for purposes of cross-context behavioral advertising.  The California Privacy Rights Act (“CPRA”) broadly defines “sale” as any sharing of personal information with third parties in exchange for monetary or other valuable consideration. The CPRA defines “sharing” as sharing personal information with a third party for cross context behavioral advertising. We work with other companies and businesses to deliver interest-based ads to you.  In working with other companies and businesses, we may disclose personal information in a way that is “selling” or “sharing” personal information as defined by the CPRA.  You can request to opt-out of the sale or sharing of your personal information for cross-contextual behavioral advertising by clicking on the “Cookie Settings (Do Not Sell or Share My Personal Information)” link, which is also available at the footer of our websites.

7. Privacy Protection for Children

We recognize the need to provide further privacy protection for children.

Our Sites are intended for a general audience and are not specifically directed to children under the age of thirteen (13).  We do not knowingly collect personal information from persons under the age of thirteen (13) without verifiable parental consent.  If we learn that a child under the age of thirteen (13) has submitted personally identifiable information without parental consent, we will take all reasonable measures to delete such information from our databases and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law).  If you become aware of any personally identifiable information we have collected from children under thirteen (13), please contact us by visiting www.thecampbellscompany.com/ccpa-request  or by calling us at 1-800-257-8443.

Please note that, while we make reasonable efforts to comply with such requests, deletion of your personal information does not ensure complete and comprehensive removal of that data from all systems.

8. International Considerations – Transfer of Data

Please be aware that information you provide to us or that we obtain as a result of your use of the Sites may be collected in your country and subsequently transferred to the United States or another country in accordance with applicable law.  Our primary data centers and headquarters are in the United States. We have affiliates, vendors, customers, and other third parties with which we do business in other countries. If we disclose personal information to an individual or entity outside of the United States, we will seek assurances that any information we may provide to them is adequately safeguarded and in accordance with applicable privacy laws. The privacy and data protection laws in the country to which your information is transferred may not be equivalent to such laws in your country of residence.

Our Sites are maintained in and governed by the laws of the United States of America. By using this site, you authorize the export of your personal information to the United States and its storage and use as specified in this Policy.
